The President of the Republic has chosen the names that will be nominated for the four vacant seats on the Administrative Council for Economic Defense (CADE). The nominations were published in today's edition, November 21st, of the Official Gazette of the Union.
The nominees possess technical profiles and relevant track records in the Federal Government, in the fields of law and/or economics:
(i) José Levi do Amaral, Secretary-General of the Presidency of the Superior Electoral Court and former Attorney General of the Union;
(ii) Camila Cabral Pires Alves, former chief economist of the Economic Studies Department at CADE;
(iii) Diogo Thomson de Andrade, deputy superintendent of CADE; and
(iv) Carlos Jacques Vieira Gomes, legislative consultant to the Federal Senate in Economic Law and Business Law.
Since the beginning of November, the Tribunal has lacked its minimum quorum for operation: only three of the seven seats on the body are occupied, which needs at least four full members to function normally. The lack of a quorum suspends the deadlines stipulated in the Competition Law (Law No. 12.529/2011), impacting the closing of corporate transactions requiring mandatory notification and the adjudication of cases of anti-competitive conduct. With the appointment of at least one new member, the Tribunal's deadlines will return to normal.
The names will now need to be evaluated and approved by the Federal Senate.
